In cases where an appeal is possible (except in cases when it is ONLY Section I – placement – that is disputed) then formal mediation has to be considered.
This involves calling one of the local Mediation Services and arranging a time to discuss the mediation process.
There are two ways forward; mediation can be declined or agreed.
If mediation is declined, a Mediation Certificate is issued, and an appeal to SENDIST can be made.
If an agreement is made to proceed with mediation, the LA must ensure that a decision-maker attends any such meeting. Witnesses can also attend, as well as the Mediation facilitator.
The meetings are not as formal an appeal, and discussions remain confidential, but a decision must be made by the LA at the end of the meeting as to whether the disputed decision is to remain the same, or will be changed.
If still dissatisfied, then an Appeal to SENDIST can now be made.
The Mediation Certificate issued at the end of the meeting has to be sent with the Appeal form.
